These Terms & Conditions (“Terms”) govern all services provided by Winbert Construction & Interior Design (“Winbert,” “we,” “our,” “us”) to clients (“you,” “your”). By engaging our services, you agree to comply with these Terms.
Winbert provides construction, renovation, and interior design services as outlined in project proposals or contracts.
Any additional work outside the agreed scope will require a written variation order and may incur extra charges.
All quotations are valid for 14 days from the date of issue.
A deposit of 70% is required before commencement of work.
Payments must be made according to the agreed schedule. Late payments may attract interest at 10% per month.
Winbert will make reasonable efforts to complete projects within agreed timelines.
Delays caused by factors beyond our control (e.g., weather, supply chain issues, client changes) will not constitute breach of contract.
Winbert uses quality materials sourced from trusted suppliers.
Manufacturer warranties apply where provided.
Winbert does not guarantee against natural wear and tear or misuse of materials.
Winbert shall not be liable for indirect, incidental, or consequential damages.
Our liability is limited to the value of the contract.
All designs, drawings, and proposals remain the intellectual property of Winbert until full payment is received.
Clients may not reproduce or share Winbert’s designs without written consent.
Either party may terminate the contract with written notice if the other party breaches these Terms.
Upon termination, the client must pay for work completed and materials procured.
These Terms are governed by the laws of Kenya. Any disputes shall be resolved through negotiation, and if unresolved, referred to arbitration in Nairobi.
Winbert reserves the right to update these Terms at any time. Updated Terms will be communicated to clients and apply to future engagements.
